Terms of Use

These Terms of Use ("Terms") govern your use of the FanzZone mobile application ("the App"), operated by FanzZone ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Using the App

• You must be at least 13 years old to use the App.
• We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial enjoyment of live events.
• You are responsible for keeping your account credentials secure and for all activity under your account.

2. Acceptable use

You agree not to:

• Reverse engineer, decompile or tamper with the App, including its audio-token detection;
• Generate, replay or interfere with in-venue audio tokens or other event signals;
• Use the App to harass others, disrupt an event, or breach venue rules;
• Use automated means to access the App or redeem offers;
• Use the App for any unlawful purpose.

3. Offers and rewards

• Offers, rewards and experiences delivered through the App are provided by us or by event and venue partners, and are subject to availability and the partner's own conditions.
• Offers have no cash value, cannot be transferred or resold, and may be modified or withdrawn at any time.
• Redemption may require you to be physically present at a participating venue.

4. Event content and accuracy

Event information, notifications and live updates are provided in good faith but may be delayed, incomplete or occasionally inaccurate. The App is a companion to live events — it does not replace official event communications, safety announcements or venue staff directions.

5. Intellectual property

The App, the FanzZone name and logo, and all related content are owned by us or our licensors. Nothing in these Terms transfers any intellectual property rights to you. Event and venue names, logos and content remain the property of their respective owners.

6. Privacy

Our collection and handling of your personal information is described in our Privacy Policy, which forms part of these Terms.

7. Availability and changes

We may update, suspend or discontinue the App or any feature at any time. We may also update these Terms; if changes are material we will notify you through the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

8. Disclaimers and liability

The App is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all implied warranties and are not liable for indirect or consequential loss arising from your use of the App. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded; where liability cannot be excluded, it is limited to re-supplying the relevant service.

9. Termination

We may suspend or terminate your access to the App if you breach these Terms. You may stop using the App and delete your account at any time.

10. Governing law

These Terms are governed by the laws of Australia. Any disputes will be subject to the non-exclusive jurisdiction of the Australian courts.

11. Official contest & sweepstakes rules

From time to time the App makes contests, prize draws, sweepstakes and similar promotions (each a "Contest") available to users. These Official Rules apply to every Contest run through the App. Where a specific Contest publishes its own additional details — such as the prize, entry period, entry method or eligibility — those details are shown alongside that Contest in the App and form part of these Official Rules for that Contest. If there is any conflict, the Contest-specific details prevail for that Contest.

Apple and Google are not sponsors of, and are not involved in any way with, any Contest. Each Contest is solely sponsored and administered by FanzZone and/or the relevant event or venue partner, and not by Apple Inc. or Google LLC. Any questions, comments or complaints about a Contest must be directed to us, not to Apple or Google.

a. Sponsor

Unless a Contest states otherwise, the sponsor and promoter of each Contest is FanzZone ("Sponsor", "we", "us"). Some Contests are run together with an event or venue partner, who is identified in the Contest details in the App.

b. No purchase or payment necessary

No purchase or payment of any kind is necessary to enter or win a Contest. The App is free to download and use. A purchase will not improve your chances of winning. Standard data charges from your mobile carrier may apply.

c. Eligibility

• You must be at least 18 years old (or the age of majority in your place of residence, if higher) at the time of entry, unless a Contest expressly permits entrants aged 13–17 with verifiable parental or guardian consent.
• You must have a valid account in the App and comply with these Terms.
• Entry may require you to be physically present at a participating event or venue at the relevant time, where this is stated in the Contest details.
• Employees, officers and contractors of the Sponsor and of any associated event or venue partner, and their immediate families, are not eligible to win.
• Contests are void where prohibited or restricted by law.

d. Promotion period

Each Contest runs only for the entry period shown in the Contest details in the App. Entries received outside that period are not eligible. We may start, pause, extend or end a Contest where permitted by law and as described in these Terms.

e. How to enter

Contests are surfaced in the App, typically when your device detects an in-venue audio token during a live event. To enter, follow the on-screen instructions for that Contest — for example tapping to participate in an activity or offer. Unless a Contest states otherwise, the limit is one entry per person. Entries that are incomplete, automated, fraudulent, or that tamper with or simulate audio tokens or other event signals, are void.

f. Prizes

• The prize for each Contest is described in that Contest's details in the App. Prizes may include offers, rewards, vouchers, merchandise or experiences provided by the Sponsor or by an event or venue partner.
• Prizes are non-transferable, non-refundable and, unless required by law, cannot be exchanged for cash. Redemption may require you to be present at a participating venue and may be subject to the partner's own conditions and to availability.
• If an advertised prize becomes unavailable, we may substitute a prize of equal or greater value.
• You are responsible for any taxes that apply to a prize you win.

g. Winner selection and notification

Winners are determined as described in the Contest details — for example by random draw from eligible entries, or on a first-eligible-entry basis for instant-win offers. Unless stated otherwise, draws are conducted by or on behalf of the Sponsor and the decision is final. Winners are notified through the App and/or by push notification. If a winner cannot be contacted, does not respond, or does not claim a prize within the time stated, the prize may be forfeited and an alternate winner selected where permitted by law.

h. General conditions

We may disqualify any entrant who breaches these Terms or these Official Rules, or who tampers with the operation of a Contest. To the maximum extent permitted by law, the Sponsor and its partners are not liable for any loss arising from participation in a Contest or use of a prize, and nothing in these Official Rules limits rights you have under the Australian Consumer Law that cannot lawfully be excluded. Each Contest is governed by the laws of Australia, as set out in section 10 above.
